REAL ESTATE LAW

Have you just purchased a home and found that it is not all it was represented to be? Or maybe it’s near the end of the month and you just discovered that your commercial tenant departed over the weekend leaving you with an empty space and a lender who expects its payment by the first of the following month. If you find yourself in one of these situations or another real estate related predicament, the Brei Law Firm can help. Our firm represents individuals and entities in real property disputes including Failure to Disclose Defects, Misrepresentation, Fraud, Evictions, Lease disputes, Lending and Foreclosure matters, Neighbor disputes, Injunctions Against Harassment, Homeowner/Association disputes, Boundary disputes, Title defects and Professional Malpractice. We represent Buyers, Sellers, Homeowners, Commercial Property Owners, Landlords, Tenants, Lenders, Borrowers, Homeowners’ Associations, Brokers, Agents, Appraisers and Surveyors.

In addition to matters that require resolution in the Court system, the Brei Law Firm also provides representation to parties who develop, invest in, buy, sell and lease real property. Whenever you are involved in a real estate transaction, whether it’s signing a lease, buying a home or investing in a commercial building, you should consider retaining counsel. Oftentimes, people do not think about hiring a lawyer until after the transaction closes and they realize an important detail has been overlooked. To avoid that situation, think about retaining a lawyer on the front end of your real estate transaction so as to avoid the potential for a future dispute.

CONSTRUCTION LAW

Our Construction practice started 21 years ago in San Diego, California. At that time, we represented Developers, General Contractors, Subcontractors, Architects and Engineers in complex construction defect lawsuits involving large residential subdivisions. Today, we continue that practice in California and have expanded it to Arizona and Nevada. We also represent Homeowners and Commercial Property Owners in all construction related matters involving defect, payment, delay, warranty, and lien claims. We utilize a select group of construction experts, as well as our own experience, to identify the issues plaguing a home or commercial project and to develop the appropriate scope and cost of repair. In terms of defects, we have experience with all defective conditions including those that are most common such as leaking roofs, windows and doors, cracked concrete slabs, drywall and flooring and expansive sub-surface soils. We assist our clients in all Arizona, California* and Nevada* Courts as well as matters before the Arizona Registrar of Contractors and its Recovery Fund.   (*Suzanne L. Brei is licensed in Arizona, California and Nevada.)

In addition to representation in Construction disputes, we also assist parties with the review and drafting of construction agreements including general contractor, subcontractor and design professional agreements.

BUSINESS LAW

In business, customers do not always pay their bills, partners do not always see things your way and competitors and employees may try to gain an unfair and sometimes unlawful advantage. Often times, business owners ignore these circumstances too long, hoping for the best. Over the last 19 years, we have found that business owners who seek legal advice early in a dispute stand a better chance of avoiding the courtroom altogether and the potential for a less than favorable outcome. Even before you find yourself in a business dispute, consider incorporating a lawyer into your business. Think about the last time you signed a Lease for your business, an agreement with your partner or a large purchase contract with your customer without having a lawyer review it first. It may seem like an unnecessary expense to get a lawyer’s opinion on the front end, but if you have ever been through a legal proceeding, you understand that having the advice up front outweighs the stress and costs of a dispute that could have been avoided. Finally, you should consider having a lawyer review the documents you use every day in your business to ensure that you are protected.

In addition to helping business owners with disputes and document review and preparation, we also assist in the purchase and sale of businesses and their assets. Along with your accountant, our Tucson Law Firm assists in the drafting, negotiation and finalization of the contractual documents needed to complete the transaction.

Tucson Personal Injury Lawyer

PERSONAL INJURY LAW

Our involvement in Personal Injury cases began when we represented negligent drivers who caused automobile accidents. In those cases, the negligent driver’s insurance company hired us to defend the interest of that driver. Based on that experience, we learned a great deal about the insurance companies’ decision making process in handling lawsuits filed by the driver who was not at fault and who suffered personal injuries. Today, utilizing that experience, we represent drivers and pedestrians who have been injured in accidents involving cars, trucks, motorcycles and bicycles.
